Not to defend barrett who I don’t much care for but the comments on Roe being settled precedent were from her appeal court confirmation and appeal courts (theoretically) don’t have authority to disregard or alter precedent in a way the supreme court does.
They absolutely do have that ability and do so all the time and she also said the same thing verbatim to a group of conservatives about what the conservative Supreme court should and would do regarding Roe which is a big fat nothing.
I get that, hence my theoretically bit. Supposed conservative judges will claim that their role in district and appellate jurisdictions is just to apply existing precedent. Liberal justices don’t ever really claim such deference and certainly don’t decide with that deference.
Not saying I think barrett will overturn or even limit roe. But they always say that on the abortion stuff during appellate confirmations and if they’re on the scotus shortlist wouldn’t dare issuing an opinion on Roe or PP v Casey that would jeopardize confirmation to scotus.
It’s not theoretically it’s just wrong.
They also don’t “always say these things” at appellate confirmation hearings AND in front of private audiences consisting of conservative think tank members and lawyers.

This country’s legal system just has a facially schizophrenic understanding of what its court system is supposed to accomplish. On the one hand, you have that fluidity, which I think is meant to bring dynamism and responsiveness to individual cases to get to the “right outcome” in edge cases, but which is also obviously ripe for abuse. I’ve noticed “independent courts” is something the US pushes along with democracy, capitalism, “human rights” etc. Very problematic and counter to “democracy”. Independent courts poz up a system. It’s like giving the human body cardiovascular disease. It literally blocks it up. And creates multiple centers of power. Independent courts are UNDEMOCRATIC and should not exist.
I think “independent courts” and democracy go hand in hand. They are both designed for the rich to buy and sell them. This is a system that is PARTICULARLY vulnerable to jews.
I think you could have democracy but not republics. You could directly elect a dictator every 6 years. That would be ideal imo if you had a homogeneous population.
