The group-libel precedent set in Beauharnais v. Illinois has not been overturned. RAV v. St Paul comes close, but it deals with “fighting words” doctrine. And even then, the majority opinion found that municipalities can legally regulate the kind of “incitement” the case dealt with, but in a content-neutral way. Under Brandenburg and RAV you don’t have a right to regulate “fighting words” or libel just because they’re racist. I do agree that he drove it into the ground and I’ll never forgive him fully for his behaviour in the last 10 years or so, but the party did prosper for a decade before it died so I feel as though you need a bit of nuance.
I suspect strongly that the only reason the BNP prospered in the post Tyndall period was because the establishment no longer felt threatened once Tyndall and the rest of the hard right were thrown out.
